Both arrests and convictions appear on a criminal record. Expungements are usually used to clear arrests from a criminal record, whereas applications for a pardon are the primary way to clear convictions from a criminal record.

  • Expungements: An expungement may be available to clear a conviction if the conviction was in juvenile court for a “youthful indiscretion” such as underage drinking. Otherwise, expungements cannot be used to clear convictions unless the applicant is over 70 years old and has not been convicted of a crime in the past 15 years. Expungements are used to clear arrests from a criminal record. Without filing an official expungement request, law enforcement and potential employers can view your arrest record.   • Pardons: If you have been convicted of a crime and expungement is not an option, then your only option to remove the conviction from your record is an application to the Board of Pardons.
