In legal terms, Pennsylvania is an “equitable distribution” state for the purposes of dividing marital assets and debts as part of a divorce or legal separation.
The guidelines of equitable distribution state that property settlements are not simply a 50-50 split of the marital assets and debts. Instead, property division settlements are supposed to represent an equitable, but fair, split. Unfortunately, the issue of what’s “fair” when it comes to property division can be litigated to death by divorce lawyers who are more concerned with their fees than they are with their clients.
