Division of Property in a Divorce

In legal terms, Pennsylvania is an “equitable distribution” state for the purposes of dividing marital assets and debts as part of a divorce or legal separation.

The guidelines of equitable distribution state that property settlements are not simply a 50-50 split of the marital assets and debts. Instead, property division settlements are supposed to represent an equitable, but fair, split. Unfortunately, the issue of what’s “fair” when it comes to property division can be litigated to death by divorce lawyers who are more concerned with their fees than they are with their clients.

We’re not that type of law firm.

At Prince Law Offices, P.C., doing right by the client has always been more important to us than our fees. Here, your time, money and assets will not be wasted by over-litigating the question of what is equitable and what is not in a marital asset settlement agreement. Call 888-313-0416 or contact us for a free consultation today, except for firearms law consults, and learn more about how we can help.

The process of creating a property division agreement is the same whether you believe you and your spouse will be able to agree on property division or whether you believe you may need to ask a judge to create a property division order:

  • Identifying which property belongs to the marriage and which property belongs to an individual spouse
  • Identifying and locating hidden assets and debts to ensure we have a complete picture of the marital estate
  • Using valuation and appraisal experts to create statements of value for property like real estate and family businesses
  • Accounting for pensions, retirement accounts, 401(k) plans and investments of all types
  • Writing qualified domestic relations orders (QDROs) to determine the division of retirement accounts
  • Creating a plan for division of marital property that meets the standards of the equitable distribution guidelines

An old cliché says that success in marriage requires “give and take.” Success in divorce (defined as minimizing its harmful effects on the whole family) is really about give and take too. Because of that, we encourage clients to be practical and reasonable about property issues whenever possible, and to stay focused on achieving results they can live with.

For two decades, we’ve been earning the trust of your family, friends, neighbors and co-workers. Today, let us earn yours.
